Terms of Service for SCAMPR

1. Agreement to Terms

By accessing or using the SCAMPR mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

SCAMPR ("we," "us," or "our") provides personalized AI-powered running training plans and coaching services. These Terms govern your use of our App and services.

2. Eligibility

2.1 Age Requirements

You must be at least 13 years old to use SCAMPR
If you are under 18, you must have parental or guardian consent

2.2 Account Requirements

You must provide accurate and complete registration information
You are responsible for maintaining the confidentiality of your account credentials
You must not share your account with others
You must notify us immediately of any unauthorized access

3. Acceptable Use

3.1 Permitted Uses

You may use SCAMPR to:

Create personalized training plans for running races
Log and track your workouts
Receive AI-powered coaching advice
Connect with other runners
Sync data with Strava (with permission)

3.2 Prohibited Uses

You must NOT:

Use the App for any illegal purposes
Violate any local, state, national, or international law
Harass, abuse, or harm other users
Impersonate any person or entity
Upload viruses, malware, or malicious code
Attempt to gain unauthorized access to our systems
Scrape, data mine, or use automated tools to extract data
Reverse engineer, decompile, or disassemble the App
Use the App for commercial purposes without permission
Create multiple accounts to circumvent limits (e.g., AI coach requests)
Post inappropriate, offensive, or harmful content
Spam other users or abuse messaging features

4. Health and Fitness Disclaimer

4.1 Not Medical Advice

IMPORTANT: SCAMPR provides general fitness guidance and training recommendations. This is NOT medical advice and should not be treated as such.

4.2 Consult Healthcare Professionals

Before starting any exercise program, especially if you:

Have pre-existing health conditions
Are pregnant or nursing
Have cardiovascular, joint, or musculoskeletal issues
Experience pain, dizziness, or shortness of breath during exercise
Take medications that affect exercise capacity
Have been sedentary for an extended period

You MUST consult with a qualified healthcare professional.

4.3 Risk Acknowledgment

You acknowledge that:

Physical exercise involves inherent risks including injury, disability, or death
Training recommendations are generalized and may not be appropriate for your individual circumstances
AI coaching advice is algorithmic and not a substitute for professional coaching or medical advice
You are solely responsible for your health and safety

4.4 Assumption of Risk

BY USING SCAMPR, YOU ASSUME ALL RISKS associated with physical training and exercise. You agree to:

Exercise at your own risk
Stop immediately if you experience pain, discomfort, or unusual symptoms
Seek medical attention for injuries or concerning symptoms

5. AI Coach Service

5.1 Usage Limits

AI coaching advice is limited to 2 requests per day
Limit resets at midnight UTC
Circumventing limits violates these Terms

5.2 AI Coach Disclaimer

AI-generated advice is based on algorithms and training data
Responses may contain errors or inaccuracies
AI cannot account for all individual circumstances
You should not rely solely on AI advice for training decisions

5.3 Data Usage

Your training data is sent to Anthropic's Claude AI (anonymized). See our Privacy Policy for details.

6. Third-Party Integrations

6.1 Strava Integration

Connecting to Strava requires explicit permission
We access only the data necessary to provide services
You can disconnect Strava anytime in Settings
We are not responsible for Strava's services or policies

6.2 Third-Party Terms

Third-party services (e.g., Strava, Firebase, Anthropic) have their own terms
You must comply with their terms when using integrated services
We are not liable for third-party service failures

7. User Content

7.1 Your Content

You retain ownership of content you create (profile, workout logs, messages). By using SCAMPR, you grant us a license to:

Store and process your content
Display your content to other users (where appropriate, e.g., social features)
Use anonymized data to improve services

7.2 Content Standards

You agree that your content will:

Be accurate and truthful
Not violate others' rights (copyright, trademark, privacy)
Not contain harmful, offensive, or illegal material
Comply with all applicable laws

7.3 Content Moderation

We reserve the right to:

Remove content that violates these Terms
Suspend or terminate accounts for violations
Report illegal content to authorities

8. Intellectual Property

8.1 Our Rights

SCAMPR owns all rights to:

The App, including code, design, and features
SCAMPR name, logo, and trademarks
Training algorithms and methodologies
App content (excluding user-generated content)

8.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8.3 Restrictions

You may NOT:

Copy, modify, or create derivative works
Sell, rent, lease, or distribute the App
Remove copyright or proprietary notices
Use our trademarks without permission

9. Payments and Subscriptions

9.1 Subscription Pricing

SCAMPR is a paid subscription service with the following plans:

Monthly: $2.00 USD per month
Annual: $20.00 USD per year (save 17%)

Your subscription includes access to all features: unlimited training plans, AI coaching, workout tracking, social features, and Strava integration.

9.2 Payment Terms

Subscriptions automatically renew unless cancelled
You will be charged at the start of each billing period
Prices are subject to change with 30 days notice
Payment is processed through Apple App Store or Google Play Store
You can cancel anytime in your device's subscription settings

9.3 Refunds

Refund policies are governed by Apple App Store or Google Play Store terms
No refunds for partial subscription periods
Contact support@scampr.co.uk for refund requests

9.4 Free Trials

We may offer free trials to new users
You must cancel before the trial ends to avoid charges
Only one free trial per user

10. Account Termination

10.1 Termination by You

You can delete your account anytime in Settings
Deletion is permanent and cannot be undone
Your data will be deleted per our Privacy Policy

10.2 Termination by Us

We may suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent or harmful activities
Create risk or legal liability for SCAMPR
Abuse features or other users

10.3 Effect of Termination

Upon termination:

Your license to use the App ends immediately
You must cease all use of the App
We may delete your data (per Privacy Policy)
Some provisions of these Terms survive termination (e.g., liability disclaimers)

11. Disclaimers and Limitations of Liability

11.1 "AS IS" Disclaimer

SCAMPR IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

Merchantability, fitness for a particular purpose
Non-infringement
Accuracy, reliability, or completeness
Uninterrupted or error-free operation

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR:

Personal injury, death, or property damage arising from app use
Errors, inaccuracies, or omissions in training recommendations
Failures of third-party services (Strava, Firebase, etc.)
Loss of data, profits, or business opportunities
Indirect, incidental, consequential, or punitive damages

YOUR SOLE REMEDY is to stop using the App.

11.3 Maximum Liability

If we are found liable despite these limitations, our total liability shall not exceed:

$100 USD, OR
The amount you paid us in the 12 months prior (currently $0)

WHICHEVER IS GREATER.

11.4 State-Specific Limitations

Some jurisdictions do not allow limitations on warranties or liability for incidental/consequential damages. In such cases, our liability is limited to the maximum extent permitted by law.

12. Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles.

For users in the European Union, mandatory consumer protection laws of your country may apply.

13. Modifications to Terms

13.1 Right to Modify

We may update these Terms at any time. We will notify you of material changes via:

In-app notification
Email to your registered address
Notice on our website

13.2 Acceptance of Changes

Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the App and delete your account.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SCAMPR.

14.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.

14.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

14.4 Assignment

You may not assign these Terms. We may assign our rights to any successor or affiliate.

14.5 No Agency

These Terms do not create any agency, partnership, or joint venture relationship.

14.6 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (e.g., natural disasters, pandemics, server failures).
